Hi dianefoley,

The individual has a right to make choices such as not using their walking frame but you have a duty to keep them safe. Hence the dilemma.

It can be resolved by carrying out a risk assessment where the safest possible compromise can be found such as using a stick instead. The individual has had their preference and choice heard and you have done all that you can under your duty of care.

Hope that helps

Hi dianefoley,

With the first question explain how you acknowledge the issue that causes the dilemma and explain the problem and your responsibilities to individual. This shows respect for the individual's rights and fulfils your duty. You could then go to the care plan, carry out a risk assessment, refer the issue to a mediator or your manager, use your complaints procedure etc

In the second question explain about risk assessments.

Hope that helps

Aunty Sue
